IVF clinics cannot use a photoreal talking patient
Health + likeness. Captions on approved clinic plates.
Health + likeness. Captions on approved clinic plates. A photoreal talking "patient" is two banned objects stacked: a private person's replica, and a synthetic persona delivering health advice. IVF content does not get a special carve-out because the tone is gentle.
Synthetic presenters on health and finance are a YPP kill is the YouTube half. A deepfake of a private person is not a style is the likeness half. This page is only the clinic brief: do not generate a face that looks like a patient and then have it speak.
The patient is not extra talent
A patient is a private figure. TikTok's AI-generated content help forbids adult private figures used without permission. "We labelled it AI" does not create a grant. "It is a generic woman in a waiting room" is not a defence if you seeded a real headshot, a review photo, or a staff Slack crop.
The clinic already has photos of people who trusted them. Feeding those into a talking generate is a replica of a private person in a health context. Invented photoreal "patients" are not a free pass. If the clip presents as a real person recounting a cycle, you have a testimonial problem. If it presents as a human expert telling the viewer what to do, you have YouTube's third bucket: AI personas as human experts on health.
Advice plus a constructed face
YouTube's inauthentic-content third heading is "AI Personas Related to Sensitive Topics." Health is named. The example is an AI "doctor" providing diagnoses, health advice, or wellness remedies. Channels built on that pattern do not monetize.
IVF is health. A synthetic face walking through "here is what you should do this cycle" is that pattern, whether you called them a doctor, a nurse, or a "community member." A credentialed RE on camera explaining their own clinic is not. A diagram or an empty waiting-room plate is not. If you cannot tell in thirty seconds whether the speaker is reporting a process or prescribing, rewrite. Reviewers are not grading empathy.
Approved plates, then type
What you can ship without a talking patient:
- Clinic plates you already cleared. Empty consult room, lab bench, exterior, a diagram the medical team signed. Generate b-roll from those stills. Do not invent a patient in the chair.
- Authored captions. The line is copy the clinic approved — hours, "what happens at the first visit," a disclaimer — burned on after picture lock. That is captions: transcribed speech if a real clinician spoke, or a fixed overlay if the words never existed in the audio.
- A real named clinician when the video tells someone what to do. Generation can still do titles and assembly. It does not get to be the adviser.
A text overlay burns one authored line. Put the legal line and the process headline on the plate. Do not ask a video model to typeset "IVF" across a generated forehead.
Do not generate customers. If you need a story, film a real patient with a replica-aware release, or do not tell a first-person story. The likeness release that covers generation is the clause list; a photo-from-the-shoot release is not enough.
The clinic test
List the last ten clips.
If eight are diagrams, rooms, and a named clinician, caption those. If four are photoreal people who do not work at the clinic, speaking as if they cycled there, those four are the problem. Pull them. Rebuild on approved plates. Do not "change 15% of the face" and call it a style.
IVF is allowed as a topic. A talking synthetic patient is not the format.
FAQ
Can we use an AI avatar if we disclose it?
Disclosure does not move a health-advice persona out of YouTube's third bucket, and it does not create permission to replica a private person. Change the format: plates and captions, or a real clinician.
What about a stylised illustration of a patient journey?
Stylised, not photoreal of a real private person, with no reference photo of a patient, can narrate a process in the third person. It still cannot prescribe. Keep claims on screen as clinic-approved copy, not as a constructed witness.
Can staff likeness be used in ads?
Only with a grant that covers generation, not just photographs. Staff are private figures. A "we already shot headshots" folder is not a replica clause. Shoot them, or keep them out of the generate.
Why not a talking avatar that only reads the website?
Because the viewer still sees a human-shaped expert in a health niche. The Help example is the persona plus the domain plus advice-shaped talk. Read the site as captions on a plate instead.
